Over the past few weeks, the Data Protection Agency’s web page (www.agenciaprotecciondatos.org) shows a Public Warning, which may be of interest to those visiting us.
We reproduce its contents below:
PUBLIC WARNING

The Agency has knowledge that messages are being sent by e-mail to automated data file managers, in which the Data Protection Agency - Inspectorate (Inspeccion@agenciaprotecciondatos.org) appears as the sender. The message states the following:
- “Having received complaints about your Internet activities for using private e-mail addresses that do not appear on our databases, we will ensue to draw up disciplinary proceedings”, reminding you that using personal data can be fined with up to 60.000 €”.
Considering the above and without detriment to the legal actions this Data Protection Agency may place, we inform you that:
1.- These e-mail messages were not sent by this Data Protection Agency.
2.- The Agency’s databases do not record private e-mail addresses.
3.- Inspection is not carried out by e-mail, but by personal visits duly authorised, stamped and signed by the Data Protection Agency’s Director or through notifications written on the Agency’s official forms and sent by ordinary post.
4.- Actions that initiate disciplinary proceedings are not communicated by e-mail. They are communicated by official agreements signed by the Agency’s Director, containing the causes for apparent infringements and legal foundations. Sufficient time is granted to present evidence and allegations.
We have knowledge, due to claims presented to the Organisation, that various companies have received phone calls from people who said they were from the Data Protection Agency, requesting bank account details to forward the costs for registering their file.
To this end, we inform you that:
1.- No phone calls like the above have been made by the Data Protection Agency.
2.- No public fee or cost is due for registering files in the Data Protection General Register.
